Why do sheriffs not carry out evictions like city police do?
If an eviction order is based on waste, nuisance or commission of a crime, it will be reviewed by the KCSO.The eviction cases will be reviewed on a case by case basis.The Sheriff must have copies of the required findings by the court and affidavits in support of their order when submitting writs.
Due to unit staffing shortages and the hazardous nature of the orders we're receiving, we need 40 days to serve and enforce the writ.It will be necessary to extend the language in the writ or order.Within 10 or 20 days of issuance, writs will not be enforced.
An eviction is when a tenant is ordered to leave a residence.The State of Washington has a tenant-landlord act.There is more information about these laws at the Revised Code of Washington.After obtaining a court order to evict a tenant, a landlord should fill out the Eviction Data Form, Adobe required, before contacting the Civil Unit for processing.All items listed on the Writ of Restitution Intake Sheet should be given to our office.They will serve the tenant or post a residence with a court order.The detectives will assist the landlord in evicting the tenant if they haven't moved by the court date.Ensuring the peace will be included in the detectives' assistance.One hour of the detective's time at the eviction is included in the advance fee.You must inform the detective in advance if you anticipate the eviction will require additional time.The landlord is responsible for the moving crew.The landlord should contact the detective prior to the eviction.Some exceptions can be found under the links above.There is more information in the Procedures for Writs of Restitution.
